This privacy statement applies to all your personal data that we collect, use, share and store when you use using the Brink Home Communication Service and the corresponding App and Portal for controlling your Brink products, or when you contact us about these products and services.

Brink Products and the Brink Home Communication Service

In this privacy statement, Brink products is defined as the Brink products in your possession produced by Brink Climate Systems B.V. that can be controlled from the Brink Home Communication Service. This privacy statement applies to all personal data that we collect, use, share and store in connection with the operation of the Brink Home Communication Service with corresponding App and Portal.

IV. What data do we collect and how do we do that?

Brink Home Communication Service

When you use the Brink Home Communication Service to control your Brink products, we collect the following information about you:

  1. Personal data for registration at the Portal.
    • Email address, password and language.
    • To apply for installer rights we ask for a: company name, telephone number, VAT number and customer number (optional)
    • Time stamp and version of the consent in the terms of use and the privacy statement.
  2. Dates of the Brink products and Brink Home Communication Service for the purpose of ensuring the operation of the system.
    • Data and statuses of the Brink products including current and historic installation data, fault messages, trend records, available releases for other users and receiver email addresses entered by the user for fault messages and trend records.
    • Connection data of the user and the installation for safeguarding and optimising the optical use: IP address, browser used, time of setting up and terminating the connection, number of attempts to connect.
  3. Information we collect when you contact us.
    • When you mail us or chat with us, we will register the communication. When you telephone us, our support desk will register your questions or complaints in our database.

We collect these data categories in the following ways: (1) we collect information that you yourself provide to us (when setting up your Brink products, when you create an account, when you log in to your communication module or when you contact our customer service department); and (2) we automatically collect information from your Brink products and the Brink Home Communication Service as described above.

V. How do we use your data?

We use your data for the following purposes: (1) to enable us to provide our services and to communicate with you, (2) for research purposes, so we can improve our products and services (3) for the purpose of direct marketing, and (4) for keeping our records and to comply with our legal obligations.

  1. To enable us to deliver our services and to communicate with you.

    To provide our services for your Brink Products and the Brink Home Communication Service, we need most of the information described in section IV.

    We use your account information and contact information to personalise your Brink Products and the Brink Home Communication Service and to send you service messages, such as news about security updates or new functionalities. We use your contact information to answer your questions when you contact us.

    The settings information and the information about your use of your Brink Products and the Brink Home Communication Service are used to monitor whether your Brink Products and the Brink Home Communication Service perform adequately and to improve your user experience.

  2. Research to improve our products and services

    We are conducting research into general trends and the manner in which our customers use our products and services. We do this to gain a better understanding of the behaviour and the preferences of our customers, so we can develop new products and services and improve our existing products and services even further.

    We can merge and analyse the information described in section IV for research purposes. We only use aggregated data and we will not use your email address or other information that can directly traced to you personally.

  3. Direct marketing

    We can use your account and contact information to send you information about your updated products and services of our brands that might be of interest to you. You may always choose to no longer receive these messages by following the instructions in the relevant marketing communication.

  4. Keeping our records up-to-date and complying with our legal obligations

    We collect, store and use your data for internal purposes, such as for keeping our records up to date and complying with our legal and tax requirements.

    We collect, use, share and store your personal data to provide our services to you, to comply with our legal obligations, to protect our legitimate interests as well as your privacy and that of third parties, or based on your consent.

    You may revoke your consent at any time by cancelling your account, which will also remove all data. We may not be able to provide the services requested by you or part of those if you withdraw your consent or if you refuse to provide the personal data that we request from you in connection with the performance of the agreement or to comply with a legal obligation. When we process your personal data for our legitimate interests or those of third parties, we will take all reasonable precautions to prevent your interests from being harmed. For example, our legitimate interests may include security and safety measures or the improvement of our product range and our services to you. For more information about these interests, please refer to the above purposes for which we process your personal data.

VI. Which third parties have access to your data?

For the following purposes, your personal information may be transferred to or shared with our group companies, service providers and partners: (1) to be able to provide our services to you, (2) in support of our operating functions and (3) for research purposes and direct marketing.

If you wish, you can allow your installer access to the technical data of your Brink product or products. Your installer may consult these data to inspect the status of your installation and whether any maintenance is necessary.

  1. To deliver our services to you

    In certain cases, we offer you services in cooperation with one of our partners, for example in the field of home automation. In such cases, we may exchange your information with these partners so that you can benefit optimally from our joint services. We only do this if we think that our services will benefit from the contributions of these external parties. Moreover, we will not share your details with these partners until we have informed you of our plans.

  2. To support our operating functions

    In some cases, we may share your personal information with trusted third parties to perform operating functions (e.g. hosting providers) or the provision of services on our behalf (e.g. support services). Such third parties are obliged to adequately protect your data and process such data strictly according to our instructions.

  3. Research and direct marketing

    Brink Climate Systems B.V. is part of Ariston Group Spa., Italien. Within our group we may exchange information for research and direct marketing purposes (see item V.3 above).

    If we are legally obliged to do so, we may also share your personal data with regulators and investigative authorities or the tax authorities.

    We may share aggregated, non-personally identifiable information with third parties. We will ensure that this information cannot be traced back to specific users of our products and services.

    Our group companies, service providers and partners may be established in a country outside the European Economic Area (EEA), that is all EU countries plus Liechtenstein, Norway and Iceland). In such cases, there is an international transfer of personal data. The laws and regulations in these countries do not always provide the same level of protection for your personal data as the laws and regulations in the Netherlands. If necessary, we will ensure that appropriate safety measures are taken to ensure that the regulations with respect to international transfer of personal data will be respected, as laid down in the standard contractual provisions laid down in European connection.

VII. Use of cookies

For authentication purposes, anonymised cookies are used as necessary for the performance of the service. These exclusively exist during the current browser session and are deleted when the browser is closed. No cookies are stored permanently on your pc. At all times, the use of cookies may be deactivated through your browser settings.

How do we ensure that your data are safe and how long do we keep your data?

We take the necessary technical and organisational measures to ensure that your personal data are properly secured and thus protected against unauthorised or unlawful use, alteration, unauthorised access or disclosure, unintentional or unlawful destruction and loss.

We store your data in our systems for as long as this is necessary for the purposes described in this privacy statement, or to the extent that this is necessary to comply with all legal obligations and for settling disputes. When you delete your account or if we no longer need your data, we will delete or anonymise the data.

Some information is processed or stored directly in your App. You can delete such information by deleting the App.

IX. How can you exercise your legal rights?

You can contact us to request access to your personal data for updating and amending. You can also exercise all other rights under the applicable data protection laws and regulations, including the right to delete or limit the processing of your personal data. You may also ask us to transfer your data part of those to other organisations. You may also have the right to object to certain forms of processing of your personal data, and -in those cases where we have requested your permission- to withdraw your permission.

Note: In certain cases, we may ask you to supply additional information to enable us to establish your identity. There may be certain limitations to the rights described in this paragraph, for instance if we can demonstrate that we are under a legal obligation to process your data. Because of the way in which we organise certain services, it may take some time before backups have been erased and we may store certain data if we are obliged to do so for legal reasons.

Requests for access, correction, restriction or removal failure may be submitted free of charge by sending an email to privacy@brinkclimatesystems.nl.

You can also contact us in all cases with remarks and/or complaints with regard to this privacy statement by sending an email to privacy@brinkclimatesystems.nl. In the event of unresolved problems, you also have the right to lodge a complaint with the Personal Data Authority.

Terms of Use

1. General

The following terms of use in their respective valid versions govern the terms of registration and use of the Brink Home Communication Service via the Brink Climate Systems B.V. ("Brink") web portal ("Portal") and app ("App"), by (i) owners/rights holders of a Brink product and (ii) registered installation companies.

You agree to the terms of use by using the Brink Home Communication Service via the App and/of Portal (including downloading and installing those).

Brink reserves the right to amend these terms of use at any time and without stating reasons and will, at least one (1) month prior to the effective date of the amended terms of use, inform you of the amended terms of use via the App or Portal or via email and give you the opportunity to take note of the amended terms of use. If you do not wish to accept any amendment or supplement, you may terminate the agreement prior to its effective date by deleting your account. Use of the service after the effective date shall be deemed to constitute acceptance of the amended or supplemented terms of use.

Non-compliance with the terms of use will automatically make the right of use for the Brink Home Communication Service expire.

2. Control of Brink products via Brink Home Communication Service

You may control various products via the Brink Home Communication Service. You will find the necessary information about this subject in the user manual of your Brink product. The suitable products are referred to below as: “Brink products and/or Brink product”.

3. Right of use

  1. As long as you comply with these terms of use, Brink grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable right to use the software and the Brink Home Communication Service to control your Brink products that are located within Europe.
  2. At any time, Brink has the right to adapt or terminate the App and Portal, to modify or remove data, to deny you the use of the App and Portal by terminating the licence, to restrict the use of the App and Portal or to wholly, partly, temporarily or permanently deny you access to the App and Portal. Brink will inform you about this in an appropriate manner.

4. Use of the service

  1. You are required to register through www.brink-home.com to access the Brink Home Communication Service. On registration, you are obliged to supply the requested data correctly and completely. Registration requires entry of the product location and email address as well as a username and a password. An email message with a confirmation link will be sent to the registered email address. Activation of the confirmation link completes the registration.
  2. At the time of registration, you expressly accept that:
    • the Brink Home Communication Service controls the following functions of your Brink products: modifying operating mode, parameters, basic settings;
    • your personal data will be processed when using the Brink Home Communication Service, in accordance with the provisions of the corresponding privacy statement;
    • these terms of use apply.
    When you register, Brink automatically obtains the writing rights for your Brink product. The Portal offers you the possibility to deactivate Brink's writing rights.
  3. When using the Brink Home Communication Service, you are required to observe all guidelines and safety measures prescribed by Brink for this purpose. You will carefully handle your username and the corresponding password, keep these confidential and refrain from sharing these data with third parties. The use of the App and/or Portal is your own responsibility. All your actions, for instance a request, a modification of data or a request for repairs, effected on or through the App and/or Portal are exclusively for your own account and risk. You are responsible for the accuracy of information and data that are transmitted via the App and/or Portal to Brink (and any third parties engaged by Brink). Brink is not under an obligation to check your data
  4. You are not permitted to make the App and Portal available to third parties, to sell, rent, decompile or reverse engineer those or to amend those without Brink's prior consent. Similarly, you are not permitted to remove or bypass any technical provisions intended to protect the App and Portal or to have those removed or bypassed.
  5. It is prohibited to use the Brink Home Communication Service for acts that are in violation of Dutch or any other applicable laws and regulations. This includes using the service to store or disseminate information that is libellous, defamatory or racist.
  6. If Brink discovers that you are in breach of the above terms, or receives a complaint to that effect, Brink may take action to end the breach. If, in the opinion of Brink, nuisance, damage or any other danger arises for the functioning of the computer systems or the network of Brink or third parties and/or the provision of services over the internet, in particular through excessive sending of email or other data, leaking of personal data or activities of viruses, Trojans and similar software, Brink has the right to take any and all measures that it reasonably deems necessary to avert or prevent this danger.
  7. At all times, Brink has the right to report any criminal offence it has established to the proper authorities. Furthermore, Brink has the right to issue your name, address, IP address and any other identifying information to a third party that complains bout your infringement upon its rights or these general terms, provided that the correctness of the complaint is reasonably plausible, there is no other way to obtain this information and the third party has a clear interest in receiving the information.
  8. Brink may recover any loss or damage resulting from violations of these rules of conduct from you. You safeguard Brink against all claims by third parties in connection with information you post.

5. Data protection

  1. Your personal data will be processed within the Brink Home Communication Service. You consent to all forms of processing that come within the scope of the service. Please refer to Brink's privacy statement for more information. You can find this privacy statement at here.
  2. All personal data gathered in the context of the use of the Brink Home Communication Service are collected, processed and used in accordance with the applicable laws and regulations.

6. Security measures

It is your own responsibility to arrange adequate security measures to protect your internet access and your user devices (smartphone, tablet, pc etc.) as well as your access data for the Brink Home Communication Service against unauthorised use, and against the consequences or consequential damage that could result from non-observance of sufficient security measures.

7. Intellectual property rights

All intellectual property rights and/or similar rights to the App and Portal and its contents, including the underlying software, images, trade names and brands, are solely and exclusively held by Brink or its licensors. You safeguard Brink against any claims by third parties in connection with your breach of their intellectual property rights.

8. Management and maintenance

Brink has the right to permanently to temporarily shut down the App and/or Portal or have it shut down or to permanently or temporarily limit its use or to have its use limited, for example if this is necessary in connection with an adaptation, modification or supplement to be made or in connection with the performance of maintenance, necessary or otherwise. You safeguard Brink against any liability whatsoever with regard to any consequences that this permanent or temporary shutdown or limitation may entail for you.

Warranty and liability

  1. Brink has compiled and described the contents of the Brink Home Communication Service via the App and Portal with utmost care and attention. Brink does not guarantee the absence of any defects or other imperfections, in particular incompleteness, or information that is not up to date or not correct.
  2. The use of the Brink Home Communication Service is entirely for your own risk. Except in the case of intent or gross negligence, Brink is not liable for damage caused by the use of the Brink Home Communication Service via the Portal or via the App or by failure to comply with these terms of use.
  3. Brink is also not liable for the inaccessibility of the Brink Home Communication Service, for the loss of data or other damage caused to you as a result of malfunctions or failures.
  4. Brink is expressly not liable for indirect damage, consequential damage, loss of profit, loss of savings and losses due to business interruption.
  5. Brink does not guarantee that the App and/or Portal are continuously functioning, free of viruses, errors and/or defects of any kind or nature. You are responsible for ensuring that you have fully secure access to the App and Portal. In this connection, you cannot hold Brink liable or present any claims.
  6. You will safeguard Brink against any claims from third parties, for any reason whatsoever, in respect of any compensation for loss or damage, costs or interest or other types of compensation, in connection with or arising from the use of the App and/or Portal and/or a violation of these terms of use and/or any other rights of third parties.

10. Technical requirements for the use of the Communication Service

System requirements for the use of the portal:

  • Common browser with recent update

System requirements for the use of the App:

11. Compensation and settlement

Use of the App and Portal is free of charge and without any engagement. Costs associated with gaining access to the internet and the use of mobile data and peripheral or other equipment are for your own account.

12. Termination

You can cancel and terminate your Brink Home account effected through the App and/or Portal at any time.

13. Final provisions

  1. This agreement is governed by Dutch law.
  2. Except where the rules of mandatory law prescribe differently, all disputes in connection with the Brink Home Communication Service will be submitted to the competent Dutch Court in the district in which Brink has its registered seat.
  3. If a provision of these terms of use requires a communication to be made 'in writing', that will be complied with if the communication is made by email or the communication is made through the Service, provided that it is sufficiently established that the message actually originates from the alleged sender and that the integrity of the message has not been compromised.
  4. The version of the communication or information as stored by Brink is deemed to be correct, unless you provide evidence to the contrary in this regard.
  5. If a provision of these terms of use appears to be void, that will otherwise not affect the validity of the entire terms of use. In such event parties will decide upon one or more provisions that embody the meaning of the original provision as far as legally possible.
  6. Brink has the right to transfer its rights and obligations under the agreement to a third party that takes over the Brink Home Communication Service or the operational activity in question.
